1. Definitions 

‘Campaign’ means the “Your Head Start at Broadstead” incentive campaign conducted by the Developer in connection with the Stage 3B launch at the Community. 

‘Community’ means the development project being carried out by the Developer at Broadstead, Kilmore. 

‘Contract of Sale’ means a binding contract of sale between the Developer as the vendor and the Prospective Purchaser as the purchaser relating to an Eligible Lot. 

‘Deposit’ means an amount equal to 10% of the Price payable in relation to an Eligible Lot by cash or bank guarantee or as otherwise agreed in writing by the Developer. 

‘Developer’ means JD Kilmore Pty Ltd 650 967 025 or its related entities responsible for developing the Community. 

‘Eligible Lot’ means Lots 351, 352, 353, 354, 355, 356, 357, 358, 359, 360, 361, 362, 363, 364 and 371 within Stage 3B of the Community. 

‘Head Start Bonus’ means a rebate of AUD$15,000 (inclusive of GST) applied at settlement of an Eligible Lot, subject to these terms and conditions. 

‘Offer Period’ means the period commencing at 9:00 am AEST on 25 July 2026 and ending on the earlier of: (a) 5:00 pm AEST on 5 September 2026; or (b) the date on which all ten (10) Head Start Bonuses have been allocated by the Developer. 

‘Price’ means the total consideration (including GST) payable by a Prospective Purchaser to the Developer in relation to the sale of an Eligible Lot. 

‘Prospective Purchaser’ means a natural person over the age of 18 years who enters into a Contract of Sale for an Eligible Lot during the Offer Period. 

‘Unconditional’ in relation to a sale means a Contract of Sale: 

  1. which is binding against both the Prospective Purchaser and the Developer as the vendor; 
  1. which is not subject to the satisfaction of any conditions precedent; and 
  1. does not include a condition that allows either party to terminate without penalty. 
  1. The Offer 
  1. The Developer is offering a Head Start Bonus of AUD$15,000 to each of the first ten (10) Prospective Purchasers who enter into an Unconditional Contract of Sale for an Eligible Lot during the Offer Period. 
  1. The Campaign is limited to a maximum of ten (10) Head Start Bonuses in total. Allocation will be determined on a first-come, first-served basis by reference to the date and time of exchange of the Contract of Sale, as determined by the Developer in its absolute discretion. 
  1. Eligibility 
  1. To be eligible for the Head Start Bonus, a Prospective Purchaser must: 
  1. enter into a Contract of Sale for an Eligible Lot during the Offer Period;  
  1. pay the Deposit in accordance with the terms of the Contract of Sale; and 
  1. proceed to and complete settlement of the Eligible Lot in accordance with the Contract of Sale. 
  1. The Head Start Bonus is limited to one per Contract of Sale and one per Prospective Purchaser (or group of related purchasers acquiring a single Eligible Lot). 
  1. Payment 
  1. The Head Start Bonus will be applied as a rebate at settlement of the Eligible Lot. The Head Start Bonus is not payable at or before the signing of the Contract of Sale.  
  1. If a Prospective Purchaser terminates or rescinds the Contract of Sale prior to settlement for any reason, the Head Start Bonus will not be payable and the Prospective Purchaser will have no claim against the Developer in respect of the Head Start Bonus. 
  1. Personal information 
  1. Personal information will be handled in accordance with the Contract of Sale and the Developer’s Privacy Policy which can be viewed online at https://broadsteadkilmore.com.au/privacy-policy/.  
  1. Other terms and conditions 
  1. This Campaign cannot be used in conjunction with any other offer, campaign, promotion or incentive without the Developer’s prior written approval.  
  1. The Head Start Bonus is not an offer of finance. The Developer takes no responsibility and is not liable for any stamp duty, strata levies, tax liabilities or government charges arising in connection with the Campaign or the Head Start Bonus. 
  1. Where the Developer permits a Prospective Purchaser to terminate a Contract of Sale by reason of demonstrated genuine hardship on the part of the Prospective Purchaser, and a substitute purchaser is nominated by deed of nomination or by replacement of the Contract of Sale for the same Eligible Lot, the Head Start Bonus shall remain payable in respect of the substitute purchaser, subject to these terms and conditions. 
  1. The Prospective Purchaser and the Developer must comply with all applicable laws.  
  1. To the extent permitted by law, under no circumstances will the Developer be liable for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with a Prospective Purchaser’s participation in this Campaign or the Head Start Bonus, even if the Developer has been advised of the possibility of such damages. This clause does not limit liability for personal injury, fraud, or any other liability that cannot be excluded under the Australian Consumer Law. 
  1. All other terms and conditions in the Contract of Sale apply.  
  1. To the extent of any inconsistency between these terms and conditions and the Contract of Sale, the Contract of Sale will prevail. 
  1. The Developer reserves the right to cancel, terminate, modify and suspend this Campaign at any time in its absolute discretion. Any change to the Campaign will be communicated in writing or posted on the Developer’s website www.broadsteadkilmore.com.au
  1. Independent financial, legal or other professional advice should be sought by the Prospective Purchaser. 
  1. This Campaign is governed by the laws of the State of Victoria.
