- Definitions
‘Campaign’ means the “Broadstead Spring Campaign” incentive campaign conducted by the Developer in connection with stages 1 and 2 at the Community.
‘Community’ means the development project being carried out by the Developer at Broadstead, Kilmore.
‘Contract of Sale’ means a binding contract of sale between the Developer as the vendor and the Prospective Purchaser as the purchaser relating to an Eligible Lot.
‘Deposit’ means an amount equal to 10% of the Price payable in relation to an Eligible Lot by cash or bank guarantee or as otherwise agreed in writing by the Developer.
‘Developer’ means JD Kilmore Pty Ltd ACN 650 967 025 or its related entities responsible for developing the Community.
‘Eligible Lot’ means selected unsold lots within stages 1 and 2 of the Community.
‘Incentive’ means an incentive of $10,000 (inclusive of GST) to be provided in the form of two (2) prepaid gift cards up to a value of $5,000 each to be provided subject to these terms and conditions.
‘Offer Period’ means the period commencing at 9:00 am AEST on 10 October 2026 and ending on the earlier of: (a) 5:00 pm AEST on 30 November 2026; or (b) the date on which a Contract of Sale has been entered into for the last Eligible Lot as allocated by the Developer.
‘Price’ means the total consideration (including GST) payable by a Prospective Purchaser to the vendor in relation to the sale of an Eligible Lot.
‘Promotion Due Date’ means 15 December 2026.
‘Prospective Purchaser’ means a natural person over the age of 18 years who enters into a Contract of Sale for an Eligible Lot during the Offer Period.
‘Unconditional’ in relation to a sale means a Contract of Sale:
- which is binding against both the Prospective Purchaser and the Developer as the vendor;
- which is not subject to the satisfaction of any conditions precedent; and
- does not include a condition that allows either party to terminate without penalty.
- The Offer
- The Developer is offering the Incentive to Prospective Purchasers who enter into an Unconditional Contract of Sale for an Eligible Lot during the Offer Period, subject to these terms and conditions.
- Eligibility
- To be eligible for the Incentive, a Prospective Purchaser must:
- enter into a Contract of Sale for an Eligible Lot during the Offer Period;
- pay the Deposit in accordance with the terms of the Contract of Sale; and
- comply with the terms of the Contract of Sale and proceed to and complete settlement of the Eligible Lot on or before the Promotion Due Date.
- If settlement under the Contract of Sale is delayed directly as a result of any default of the vendor only, the Promotion Due Date will be extended by a period equal to the period of that delay (Extended Promotion Due Date), except where the delay is contributed to by the Prospective Purchaser, and the Prospective Purchaser will still be entitled to the Incentive if the Prospective Purchaser otherwise complies with these terms and conditions, including effecting settlement on or before the Extended Promotion Due Date.
- The Incentive is limited to one per Contract of Sale notwithstanding the number of purchasers named in the Contract of Sale.
- Payment
- If the Prospective Purchaser is entitled to the Incentive, it must collect the Incentive within 30 days after the Promotion Due Date from the Broadstead Kilmore Sales Office, 2/62 Sydney St, Kilmore VIC 3764. If the Purchaser fails to collect the Incentive within three (3) months from the Promotion Due Date, the Prospective Purchaser forfeits their rights to receive the Incentive and will have no further claim against the Developer in respect of the Incentive or these terms and conditions.
- Personal information
- Personal information will be handled in accordance with the Contract of Sale and the Developer’s Privacy Policy which can be viewed online at https://broadsteadkilmore.com.au/privacy-policy/.
- Other terms and conditions
- This Campaign cannot be used in conjunction with any other offer, campaign, promotion or incentive without the Developer’s prior written approval.
- The Incentive will not be transferable, exchangeable or redeemable for cash.
- The Prospective Purchaser must not deduct or set off any amount payable under the Contract of Sale by the amount of the Incentive.
- Once the Incentive is provided to the Prospective Purchaser, the Developer is not responsible for, and shall not be held liable for, the use of the Incentive, any additional terms and conditions imposed by the issuer of the gift cards or the Prospective Purchaser’s compliance with those additional terms and conditions, any card faults or defects or if the Prospective Purchaser is unable to use the Incentive for any reason (including if it is damaged, lost or stolen).
- The Incentive is not an offer of finance. The Developer takes no responsibility and is not liable for any stamp duty, strata levies, tax liabilities or government charges arising in connection with the Campaign or the Incentive.
- Where the Developer permits a Prospective Purchaser to terminate a Contract of Sale by reason of demonstrated genuine hardship on the part of the Prospective Purchaser, and a substitute purchaser is nominated by deed of nomination or by replacement of the Contract of Sale for the same Eligible Lot, the Incentive shall remain payable in respect of the substitute purchaser, subject to these terms and conditions.
- The Prospective Purchaser and the Developer must comply with all applicable laws.
- To the extent permitted by law, under no circumstances will the Developer be liable for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with a Prospective Purchaser’s participation in this Campaign or the Incentive, even if the Developer has been advised of the possibility of such damages. This clause does not limit liability for personal injury, fraud, or any other liability that cannot be excluded under the Australian Consumer Law.
- All other terms and conditions in the Contract of Sale apply.
- To the extent of any inconsistency between these terms and conditions and the Contract of Sale, the Contract of Sale will prevail.
- The Developer reserves the right to cancel, terminate, modify and suspend this Campaign at any time in its absolute discretion. Any change to the Campaign will be communicated in writing or posted on the Developer’s website www.broadsteadkilmore.com.au.
- Independent financial, legal or other professional advice should be sought by the Prospective Purchaser.
- This Campaign is governed by the laws of the State of Victoria.
